1. Purpose and acceptance

These terms of use (the “Terms”) govern access to and use of the beskapad.com website and its services (hereinafter the “Service”), published by Kaneleon (SAS).

Use of the Service implies full and unreserved acceptance of these Terms. If you do not accept these terms, you must refrain from using the Service.

2. Definitions

• User: any natural person who accesses the Service, with or without an account.
• Account: personal space created upon registration, allowing itineraries and preferences to be saved.
• Content: any element (text, image, data, itinerary) generated, displayed or transmitted via the Service.
• Itinerary: travel proposal generated by the Service based on the User’s criteria.

3. Description of the Service

Beskapad is an online service that generates personalized travel itinerary proposals based on criteria provided by the User (destination, duration, budget, preferences).

The Service aggregates and presents information from third-party sources (carriers, accommodation providers, cultural and tourism databases, event services). Beskapad is neither a travel agent nor a reseller: it sells neither tickets, nor hotel nights, nor services. Any bookings are made directly with the third-party providers, under their own terms.

4. Access to the Service

Access to the Service’s basic features is free. Certain features (saving itineraries, history, sharing) require the creation of an Account.

Beskapad strives to keep the Service accessible 24/7, without however guaranteeing continuous availability. Interruptions may occur for maintenance, updates or for reasons beyond its control (hosting outage, unavailable third-party APIs, etc.).

5. Registration and Account

Registration requires a valid email address and a password meeting the security criteria (minimum 8 characters, uppercase, lowercase, number, special character).

The User undertakes to provide accurate information and to maintain the confidentiality of their credentials. Any action carried out from their Account is deemed to have been carried out by them.

The User may delete their Account at any time from the My account area. Deletion results in the permanent loss of saved itineraries.

6. User obligations

The User undertakes to:

• use the Service in accordance with the laws in force and these Terms;
• not attempt to circumvent the Service’s security mechanisms, rate limits or technical restrictions;
• not use automated processes (scripts, bots, scrapers) to extract Service data on a large scale without prior written authorization;
• not transmit any unlawful, defamatory or insulting content, or content infringing the rights of third parties;
• not impersonate a third party or create multiple Accounts in order to circumvent a suspension.

7. Intellectual property

All the elements of the Service (code, design, brand, logos, algorithms, editorial text) are the exclusive property of Kaneleon or its partners, and are protected under copyright and trademark law.

Content from third-party sources (Unsplash, DATAtourisme, OpenAgenda, etc.) remains the property of its respective owners and is used within the framework of the applicable licenses or terms of use.

The User is granted a personal, non-exclusive, non-transferable right of use limited to the duration of use of the Service. Any commercial exploitation, resale or redistribution of the content is prohibited without prior written authorization.

8. Reliability of information and liability

The itineraries, prices, schedules and availability presented on the Service are provided for information purposes only. They come from third-party sources and may change at any time. Beskapad does not guarantee their accuracy, completeness or timeliness at the time of consultation.

It is the User’s responsibility to verify this information directly with the providers before making any decision or booking (transport, accommodation, ticketing, etc.).

Beskapad cannot be held liable for:

• errors, omissions or late updates of third-party data;
• any damage resulting from a decision made on the basis of the information provided by the Service;
• Service interruptions, data loss or malfunctions related to hosting or third-party APIs;
• disputes between the User and third-party providers (transport companies, hotels, activity organizers).

9. Third-party services

The Service may integrate or link to third-party services (mapping, images, cultural events, payment, hosting). Use of these services is subject to the terms specific to each of them. Beskapad exercises no control over these third parties and cannot be held responsible for their practices or their content.

10. Personal data

The processing of personal data collected within the framework of the Service is detailed in the privacy policy, which forms an integral part of these Terms.

11. Suspension and termination

In the event of a breach of these Terms, Beskapad reserves the right to suspend or delete the User’s Account without notice, without this giving rise to any compensation.

The User may terminate their Account at any time from their personal space, free of charge and without justification.

12. Amendment of the Terms

Beskapad reserves the right to amend these Terms at any time. Amendments take effect upon publication. The “last updated” date shown at the top of this page allows the version history to be tracked. In the event of a substantial change, registered Users will be notified by email.

13. Governing law and jurisdiction

These Terms are governed by French law. In the event of a dispute, and after an attempt at amicable resolution, the French courts within the jurisdiction of Paris shall have sole jurisdiction, subject to the mandatory legal provisions applicable to consumers.
